For years, the U.S. securities regulator SEC was the crypto industry\u2019s \u201cenfant terrible.\u201d But with Press Release 2026-30<\/a>, the agency seems to be putting an end to the guessing game. Under the motto \u201cClarity instead of lawsuits,\u201d the SEC is defining for the first time exactly when a token is a security\u2014and when it isn\u2019t. For investors in Switzerland (DLT Act) and the EU (MiCA), this means: the global standard for digital money is finally taking shape as a coherent picture.<\/b><\/p>\n

The breakthrough: The SEC\u2019s new token taxonomy<\/h2>\n

The notorious Howey Test from 1946 has had its day\u2014at least in its previous form, which was often interpreted arbitrarily. Working with the CFTC, the SEC has published a clear framework that divides crypto assets into logical categories:<\/p>\n

  1. Digital securities (securities):<\/b> Tokens that represent clear rights to profits or governance in a company.<\/li>\n
  2. Digital commodities (commodities):<\/b> This includes Bitcoin and, now officially, many other decentralized assets that function more like \u201cdigital gold\u201d or oil.<\/li>\n
  3. Utility & tool tokens:<\/b> Tokens intended purely for access to a service or a protocol.<\/li>\n
  4. Stablecoins:<\/b> These are now treated as a separate category that is closely intertwined with the banking sector.<\/li>\n<\/ol>\n

    Especially exciting: The SEC clarifies that a token originally sold as part of an investment contract (security) can, over time, become a \u201cnon-security\u201d (commodity) if the project is sufficiently decentralized. A huge win for projects like Ethereum or Solana.<\/p>\n

    Why this could be a \u201cbullish signal\u201d for the market<\/span><\/p>\n

    You might think more regulation is bad for prices. The opposite is true. Why? Institutional money loves clarity. <\/b>So far, many large pension funds and banks have avoided the crypto market because the legal risk in the U.S. was too high. If the SEC now sets clear guardrails, it\u2019s like building a solid highway compared to a bumpy mud track in the jungle. The result: ETFs and direct crypto investments become \u201csocially acceptable\u201d for the masses.<\/p>\n
